How does the promotion handle liability and release of liability for participants?
The promotion manages liability and the release from liability for participants by requiring each person who participates to agree that they will not hold the Sponsor, or any associated parties such as affiliates, partners, subsidiaries, and their officials, employees, or agents responsible for any harm or damages that might occur from participating in the promotion or from receiving and using any prizes offered.
How are taxes handled for the Grand Prize winner, and what forms and information are needed for tax reporting?
For the Grand Prize winner, tax reporting involves the issuance of a 1099-MISC form by the Sponsor, as required by the IRS for all prizes over $600. The recipient needs to provide the Sponsor with their full legal name, permanent address, and either a Social Security Number (SSN) or Taxpayer Identification Number (TIN). This information must be given on a completed and signed W-9 form. Failure to submit this form results in disqualification from claiming the prize. Regarding taxation, both federal and state governments treat the value of the Grand Prize as ordinary income, which means it is added to any other earnings the winner has for that year and reported as ‘Other Income’ on tax filings.
What is the Grand Prize winner entitled to receive, and what is its retail value?
The Grand Prize winner is entitled to receive a selection of products and services provided by the Sponsor, which altogether have a retail value of $25,000. This amount covers the expenses associated with labor, materials, any required permitting fees, and the Sponsor’s own markups. Installation of these products and services will be carried out exclusively by either the Sponsor’s own personnel or a designated representative. If the necessary products chosen by the winner require it, the Sponsor’s personnel or their designee may need to secure appropriate permits before installation can begin. Should the chosen products and services exceed the specified $25,000 retail value, the Grand Prize winner will be responsible for paying the difference.
How many entry attempts will be made to contact the Grand Prize winner?
The rules specify that the Sponsor will initially try to contact the Grand Prize winner three times over the span of three business days following the draw. If these attempts are unsuccessful, a final, fourth attempt will be made by sending a certified letter to the winner’s address as provided in their entry. This letter will be sent within fourteen days of the draw. In total, four attempts will be made to contact the Grand Prize winner.
What are the odds of winning the Grand Prize?
The likelihood of bagging the Grand Prize hinges on the total count of valid entries submitted. To illustrate, should the number of eligible submissions total 10,000, the probability of winning stands at 1 out of 10,000. The winner of the Grand Prize is chosen at random from the pool of all valid entries.
How will the Grand Prize winner be notified?
The winner of the Grand Prize will initially be contacted either through email or phone within three days after their selection. If the winner does not respond, the sponsor will make two additional attempts to reach them within this time frame. If these attempts are unsuccessful, the sponsor will then send a final notice through certified mail, requiring a return receipt, to the winner’s address provided on their entry form. This mail will be sent out within fourteen days following the draw.
